The complete process often requires 2-6 months, but timing depends on the legal route and the competent Questura. For an Article 10 EU-family residence card, the statutory issuance term is up to six months from the application. The 60-day period applicable to certain residence-permit procedures must not be presented as a universal FAMIT maximum.

A qualifying family member may work while the residence card is pending. The right flows from the applicable family status, while the official certificate or receipt proves that a properly documented application has been filed. Because the filing channel and documentary proof differ between routes, we verify that the applicant has the correct evidence for the employer and authorities rather than relying on the receipt as an unconditional guarantee.

Since June 1, 2024, qualifying family members relocating from abroad to join an Italian or EU citizen stably resident in Italy use the National Visa for family reasons. A tourist or family-visit visa remains a short-stay instrument for stays under three months. Cases involving a person already lawfully present in Italy require an individual assessment and should not be treated as an automatic conversion.

Marriage or another qualifying Article 2 family relationship may support an in-country family residence application where the legal requirements are met. A registered cohabitation agreement can strengthen evidence of a durable relationship, but it does not automatically convert the current permit or guarantee a five-year FAMIT document. Under the EU-family route, five years of qualifying continuous residence may lead to a permanent right of residence and a permanent residence card. This is legally distinct from EU long-term resident status under Article 9 TUI. There is no additional ten-year waiting period for an indefinite FAMIT card.

Travel is permitted, but absences must be assessed against the specific residence route. Under the EU-family regime, continuity toward permanent residence is generally preserved by absences not exceeding six months per year, with limited exceptions for a single absence of up to twelve consecutive months for important reasons. These are not a universal renewal rule for every FAMIT case.

Direct descendants aged 21 or over must demonstrate genuine dependency on the Italian or EU citizen, or on that citizen's spouse or registered partner where applicable. Descendants under 21 fall within the core family category without a dependency test, subject to proof of identity, relationship and the correct residence route.
