Residence Permit Conversion

There is no single conversion timeline. A complete case often takes several months, but the sequence depends on the permit being converted and may involve the Ministry's ALI portal, the Sportello Unico, the postal kit and the competent Questura.

A properly and timely filed conversion application, together with the official receipt, protects the applicant's pending residence under Article 5(9-bis). The relevant deadline depends on the source permit and conversion. The 60-day period must not be treated as a universal conversion deadline, and a late case requires immediate legal analysis.

The most common legally permitted conversions include:

• Study, training or internship to subordinate or self-employment, outside quotas since 2023
• Seasonal work to non-seasonal subordinate work, outside quotas since 2025 where the three-month work and job-offer requirements are met
• Waiting for employment to work
• A family permit to work or study when the statutory Article 30(5) circumstances arise
• Other source permits only where the current coordinated legislation expressly authorizes conversion

Every route has its own conditions and filing channel. We compare the separate subordinate-work and self-employment requirements; a permit that authorizes work is not necessarily convertible into a work permit.

The competent court and deadline depend on the legal right underlying the conversion. Many ordinary work-conversion refusals are challenged before the competent TAR, while disputes involving family-unity rights may fall within the ordinary court under Article 30(6). Conversion to subordinate work requires a qualifying job proposal or contract and any SUI authorization required for that route. Study and seasonal conversions have specific employment conditions. No. A tourist or business visa cannot be converted into a work residence permit. The normal work route requires the appropriate visa from abroad. A genuinely independent family, protection or other statutory basis may support a different in-country residence application, but that is not a conversion of the tourist visa.

Where a timely conversion has been filed for a permit that authorizes work and the applicant holds the official receipt, employment may continue or begin under Article 5(9-bis), subject to the required employment notification and the rules of the specific conversion. Seasonal-to-non-seasonal and study-to-work cases should be documented carefully before work starts.

The common core is the passport, current title or receipt and application documentation. The rest is conversion-specific: job proposal and authorization for work, professional and financial evidence for self-employment, civil-status evidence for family cases, or enrollment and resources for study. Housing suitability, criminal records and degree recognition are included only when the selected route actually requires them.
