A residence permit should normally be renewed before expiry. The recommended 60-day pre-expiry filing period is indicative, but a foreign citizen who has not requested renewal more than 60 days after expiry is generally considered irregular unless force majeure or another legally relevant circumstance applies. A late application is therefore not automatic regularization.
A renewal filed before expiry or, absent force majeure, within 60 days after expiry can preserve lawful pending status and work rights when the competent office issues the official receipt. Case law may also protect certain later applications where the substantive conditions, new favorable elements or a qualifying work relationship are demonstrated, but every delayed case requires an individual risk assessment.
